The Minutes of the meeting held on 2 August were agreed and signed as a correct record.

Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

Urgent Matters

Information to be brought forward with the permission of the Chair.

Minutes:

There were no urgent matters, but the Chair advised there would be a peg meeting on Thursday 20 September at 2pm in the Town Hall.

 

The Development Management Team Leader confirmed that the inspectors report had been received for the local plan and that the working group would meet with North Devon Council on 3rd October to discuss with a report going to Full Council at the end of October.

Future Site Visits

The Chair to advise the Committee of any future site visits.

Public Participation

The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

Application No. 1/0211/2018/OUT  -  Outline planning permission with all matters reserved for two dwellings, public picnic area & retention of coastal footpath (Resubmission of 1/1095/2017/OUTM) (Additional information in relation to ecology, sea defences, Landscape and visual impact) - Land Adjacent To Torridge Road, Appledore, Devon.

 

Interests: Councillor Councillor Davis declared a personal interest – dual hatted – Northam Town Council (Appledore Ward)

 

Officer recommendation:  Grant

 

The planning application had been called into Plans Committee by the Ward Member, Councillor K Davis for the following reasons:

 

“So that Members can consider whether the proposal is in conflict with Policy ENV6, would harm an area of scenic beauty within the Coastal Preservation Area and to consider the affect of coastal change/rising sea level”.

 

Prior to the presentation of the application, Members were informed of the following updates:

 

·         Condition number 5 needs an amendment as it doesn’t reference the correct ecology survey. If Members were minded to approve the application then the Officer recommended giving delegated authority

to make the necessary changes.

 

·         A third party objective referenced a recent refusal on the site, which isn’t referenced in the planning history. This is actually incorrect as there was a recent withdrawal on the site on 20th December however this would not be listed as it was withdrawn.

 

The Planning Officer presented the report and informed Members of the main planning considerations.

 

Following a discussion it was proposed by Councillor Watson, seconded by Councillor Hackett that the application be approved, subject to the amendment to condition 5 and condition 8 being strengthened to include that the footpath remain open during any building works.

The motion was lost.

 

The Development Team Leader reminded Members that if they were minded to refuse the application contrary to recommendation, then Members would need to state why.

 

Councillors discussed the relevant policies, which included ST09, ST01, ST02, ENV6 and DVT2C. Councillors then gave context to these policies to form the reason/s for refusal, by stating that the proposal would detract from the open landscape (Cllr Christie); was considered to be development in the open countryside (Cllr Davis) and concerns regarding the sustainability due to climate change / global warming and erosion (Cllr Christie).

 

It was proposed by Councillor Christie, seconded by Councillor Julian that the Committee was minded to refuse the application for the reasons mentioned above.

 

RESOLVED:

 

That the application be Refused for the reasons set out above.

Application No. 1/0318/2018/FUL -  Erection of a slurry store - Parklands, Fairy Cross, Bideford.

Officer recommendation:  Grant

 

 

The planning application had been called into Plans Committee by the Ward Member, Councillor A Boyle for the following reasons:

 

“Due to the lack of detail regarding agricultural justification and accurate calculations of the storage requirement, whether storage would be in addition to existing, whether the tank should have a cover, the proximity of the site to the SSSI and concerns regarding the significant increase of flies in the area”.

 

Prior to the presentation of the application, Members were informed of the following updates:

 

·         Natural England has asked officers to carry out a online Skell report to assess the emissions produced by the slurry pit. 

·         Officers completed the report and the report concluded that it was low risk however it also reported that there could be low emissions which could effect the nearest stack therefore the officer is recommending a condition be added that a lid is added to the slurry pit within two years.

 

The Planning Officer presented the report and informed Members of the main planning considerations.

 

Following a brief discussion it was proposed by Councillor Brown, seconded by Councillor Hackett that the application be approved, subject to a condition that a lid is added to the slurry pit within two years.

 

RESOLVED:

 

That the application be Granted subject to the additional Condition as stated above and the conditions as stated in the report.
