Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

Urgent Matters

Minutes:

There were no urgent matters, but the Chair informed the Committee that the next Planning Evidence Gathering meeting had been scheduled for Thursday 24 January 2019 at 10am in the Town Hall, Bideford.  This meeting will also include further training in relation to the Local Plan.

The Chair to advise the Committee of any future site visits.

Application No. 1/1169/2018/FUL  -  Proposed conversion of existing office accommodation over Barclays Bank to 9 bedroom HMO (Sui Generis Use) - 84A High Street, Bideford, Devon

 

Interests:    Councillors M Langmead and P Christie declared personal interests – dual hatted – Bideford Town Council

 

Officer recommendation:    Grant

 

 

The planning application had been called into Plans Committee by Councillor Christie for Members to consider whether this proposal is overdevelopment or not.

 

Prior to the presentation Members were:

 

·         Reminded that the application is for proposed conversion of existing office accommodation to a House in Multiple Occupation (HMO) and they must disregard any information in terms of assisted living.  

 

·         Advised of an existing permission which expires in August, for the conversion of upper floors to five in number flats.

 

The Planning Officer presented the report and advised Members of the main planning considerations.

 

During the debate Members raised a number of concerns which included:

 

·         Parking – Highways had raised no objections and considered the proposal to be acceptable.

 

·         Security for the building and individual rooms – this was not a planning matter and would be covered under the HMO Licence which the applicant was required to obtain.

 

·         Designated areas for bicycles/pushchairs, waste and recycling and the width of access to this area – the proposed plan shows a communal area which Officers had chosen not to condition.  There is no requirement under planning to provide that particular space.  There is a designated area for each room.  No objections had been raised by the Waste & Recycling Department at the Council.

 

·         Shared facilities being archaic – with only two small kitchenettes there was concern this could cause personal clashes.  Member also felt there was a need for someone to attend each day to assist with the smooth running of the HMO.  It was confirmed that the day to day running of the HMO would be covered under the Licence.

 

·         Reference was made to the statements of the applicant and Home Life. The concern was that this referred to the HMO in Barnstaple where there is “live in assistance”.  The Planning Officer addressed this issue and advised that in terms of the planning permission there is no restriction to any end user.

 

It was proposed by Councillor Lock, seconded by Councillor Watson that the application be approved.

 

A recorded vote was taken to approve the application.

The planning application had been called into Plans Committee because the land is owned by the Local Authority.

 

Prior to the presentation the Committee were informed of the following amendment to the report:

 

Page 77  -  Policy ST22 of the NDTLP – to also include:

 

·         d)  where it can be accessed without generating unacceptable levels of traffic on the local road network and / or reducing highway safety

 

The Planning Officer presented the report and advised Members of the main planning considerations.

 

During the debate all Members were supportive of the application, acknowledging the need for the additional space and highlighting the positive aspects of the Boxing Club.

 

Reference was made to a representation letter received which related to an existing outside light shining into a residents garden.   Although the application did not include any proposal for lighting, it was agreed that an additional condition be imposed stating that any future external lighting proposed be approved in writing by the Authority prior to erection.

 

It was proposed by Councillor Langmead, seconded by Councillor Langton-Lockton that the application be approved, subject to the additional condition as stated above.
