Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

Minutes:

There were no urgent matters, but with the agreement of the Committee the Chair advised there would be no Planning Evidence Gathering meeting next week.

The Chair to advise the Committee of any future site visits.

The Chair informed the Committee that there were currently no site visits planned.

The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

Councillor Christie referred to the two Appeal Decisions – Barn at Winter Garlands – where costs had been allowed, and asked that when determined, the Committee are informed of the agreed figures.  The Development Manager to update Members at a future Planning Evidence Gathering meeting.

Application No. 1/1265/2018/FUL  -  Change of use of site to B1/B8 including extension to building - Phoenix Interiors (SW) Ltd, Phoenix House, Bucks Cross

 

Interests:    Councillor Julian declared a personal interest having called in the application, but attended with an open mind.

 

Officer recommendation:     Grant

 

 

The planning application was called into Plans Committee by Councillor R Julian due to concerns on the impact upon highway safety, and in particular the increases in vehicular movements using the private driveway and A39 entrance.

 

Prior to the presentation of the application Members were informed of the following update:

 

An amendment to Page 44 of the report – the recently approved application to change the use of the L shaped structure to be amended to - reference 1/0544/2018/FUL.

 

The Planning Officer presented the report and advised Members of the main planning considerations.

 

When discussing the application Members sought clarity from the Devon County Highways Officer  as to why he had recommended refusal on a nearby site because of the visibility splays, but had no objections to this site.

 

The Highways Officer addressed the meeting and clarified his reasoning as to why he had recommended refusal on the other site but had no objections to this proposal.  He added that although this site is not perfect there would be no change to the permitted (vehicle or pedestrian) traffic accessing the site.

 

It was proposed by Councillor Watson, seconded by M Brown that the application be approved.

The planning application had been brought to Plans Committee as the applicant is related to Council member of staff.

 

The Development Management Team Leader presented the report and informed the Committee of the main planning considerations.

 

When discussing the application Members had concerns with regard to the access and visibility splay onto the C461. 

 

Following a recommendation put forward by Councillor Langmead, Members agreed that an additional condition be imposed, namely that access improvements be made within the land ownership of the applicant.  It was agreed that the wording of this condition be delegated to Officers to then forward to Members for approval.

 

Councillor Lock stated that if the application was to be approved, she recommended that the following wording be added to Condition 4:

 

“nor sold off as a separate dwelling”.

 

It was proposed by Councillor Julian, seconded by Councillor Langmead that the application be approved subject to the above.
