Declaration of Interest
Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.
Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.
The Chair reminded Members to declare their interests when the relevant item was up for discussion. Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

There were no urgent matters, but the Chair informed the Committee that due to the withdrawal of the only item on the Agenda for Plans Committee on the 1st November, the meeting had been cancelled. Therefore, there would be no site visit following this meeting.
The information, recommendations and advice contained in the reports are correct as at the date of preparation which is more than ten days in advance of the Committee meeting. Due to these time constraints any changes or necessary updates to the reports will be provided in writing or orally at the Committee meeting.
Outline application (with all matters reserved except access) for the erection of up to 260 dwellings with public open space, landscaping and sustainable drainage system (SuDS) and two vehicular access points from Abbotsham Road (AMENDED INFORMATION including enlargement to red edge and reduction in number of proposed dwellings) - Land North Of Abbotsham Road, Abbotsham, Devon.

Officer recommendation: Grant subject to Legal Agreement
The planning application had been called into Plans Committee by Councillor Christie for the following reason:
“The development is not in the Local Plan. It is in a Critical Drainage Area of Kenwith Valley”.
The application had previously been considered by the Committee at its meeting on 4 October 2018, where upon it was resolved that the Committee were minded to refuse the application. In accordance with the Committee’s Terms of Reference, Members must now consider an implications report outlining the implications, process and risks of a resolution to refuse planning permission, contrary to Officer recommendation.
Prior to the presentation of the Implications Report, Members were informed of the following updates:
· Late representation from the CPRE objecting to the application
· Late representation from a member of the public – a number of points raised had been addressed in the original Committee report. One of the key points raised was that Officer’s should have obtained expert Ecology advice. It was deemed not necessary due to the extensive Officer experience within the department, the Ecology Report submitted by the applicant and the fact that no objections had been received from Natural England.
The Planning Consultant presented the Implications Report which detailed each of the key points given by Members as reasons for refusing the proposal contrary to Officer recommendation. Members were advised that, based on discussions held, Officers advice was to remove refusal reasons 2 and 5. Clarification as to the reasoning for this was given.
Members discussed the five refusal reasons and noted the Officer recommendation to remove reasons 2 and 5. Councillor Christie’s concerns with regard to the adverse impact of flood risk on the Kenwith Valley and Dam and the removal of refusal reason 2 were noted. It was agreed that Officers obtain further information from the Environment Agency with regard to their proposed Kenwith Scheme.
Following comments made, the Legal Advisor instructed Members to give consideration and to make a decision on the planning information before them, and not on future concerns.
It was proposed by Councillor Christie, seconded by Councillor Julian that the application be refused for reasons 1, 3 and 4 set out in the Officer report.
The Planning Consultant addressed the concerns raised, and reiterated the reasons as to why Officers had recommended the application be Granted. He referred to the NPPF which outlined the importance of a site being instantly available. The proposed site is available now and, in Officers opinion, deliverable.
