Minutes:

The Minutes of the meeting held on 4 April 2019 were agreed and signed as a correct record.

Matters Arising:

 

Councillor Christie referred to the planning application for a small scale wind turbine that had been refused at the previous Plans Committee meeting because there is no support in the Development Plan for wind energy development.   He reiterated his request which he made at that meeting for Officers to address this matter, and to ensure policies are put in place as quickly as possible.

 

 

 

 

 

 

2.

Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

4.

Urgent Matters

Information to be brought forward with the permission of the Chair.

Minutes:

There were no urgent matters brought forward, but Councillor Christie sought clarification from the Planning and Economy Manager in relation to an email received by all Plans Committee Members.  The email referred to a previous planning application for a slurry lagoon in Hartland.  The Planning and Economy Manager advised a meeting had been arranged with the Environment Agency.

5.

Future Site Visits

The Chair to advise the Committee of any future site visits.

The Chair informed the Committee that there were currently no site visits planned.

Public Participation

The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

Prior to the presentation of the applications, the Chair advised the Committee and members of the public on the public speaking protocol.  He asked that respect be shown for the views of the speakers, even if their views differed.

The planning application had been called into Plans Committee by Ex Councillor K Davis so that Members can consider whether proposal would cause harm to the character and appearance of the surrounding area, or causes landscape harm contrary to Policy DM04 of the North Devon and Torridge Local Plan.

 

Prior to the presentation of the report, Members were informed of the following updates:

 

·         A representation had been received from a member of the public objecting to the application.

 

·         The CPRE had submitted a representation objecting to the application.

 

·         A representation had been received from the Ward Member, Councillor L Ford.

 

The Principal Planning Officer presented the report and advised Members of the main planning considerations.

 

The Committee addressed a concern  raised by the Ward Member, Councillor Ford, who emphasised the importance of Members attending site visits.  He was advised this is a matter currently under review.

 

It was acknowledged by Members that the site visit had been extremely valuable in assisting them to determine the application.

 

During the debate the following points/concerns were raised:

 

·         The recommendation from Devon County Highways that a 3 m foot/cycle way be provided along the entire site frontage.   The Principle Planning Officer advised that although Highways will recommend this on proposals going forward, Officers will not be taking this forward.

·         No response from the AONB as the site is not within the AONB

·         Character and appearance – the design is acceptable and fits in well

·         Second Homes – not a planning consideration

·         Distance from the site to the coast path

·         Timber fencing – Members felt this should be hedging or a stone wall

 

It became evident during the discussion that Members were minded to approve the application but had concerns with the treatment boundary being timber fencing and felt it should be hedging or a stone wall.  The Principal Planning Officer suggested a condition be imposed stating that details of the treatment boundary be submitted to the Planning Authority for approval prior to commencement of the work.

 

It was proposed by Councillor Leather, seconded by Councillor Lock that the application be approved.

Interests:  Councillor Craigie declared a prejudicial interest, having previously submitted an objection letter, left the table and took no part in the debate and decision making.

Councillor Christie declared a personal interest – dual hatted – Bideford Town Council.

 

Officer recommendation:   Grant

 

 

The planning application had been referred to Plans Committee because the application site is within the ownership of Torridge District Council.

 

At the commencement of the presentation, the Principal Planning Officer explained that the applicants are not proposing to extend the track but to remodel it.  The plan previously submitted showing an extension of the site will not be approved.

 

The Principal Planning Officer presented the report and advised Members of the main planning considerations.

 

During the brief discussion that followed, it was evident that Members were in support of the application and acknowledged the good work and support being given to the community by the BMX Club.  Many of the objection letters referred to “an extension to the track”, which, as clarified by the Principal Planning Officer, had been incorrect.

 

It was recognised by Members that the site visit had been helpful in assisting them to determine the application.

 

It was proposed by Councillor McGeough, seconded by Councillor Watson             that the application be approved.
