Declaration of Interest
Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.
Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.
The Chair reminded Members to declare their interests when the relevant item was up for discussion. Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

There were no urgent matters brought forward, but the Chair reminded Members of the Special Plans Committee meeting scheduled for 4 February 2021.
The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

Application No. 1/0858/2020/FUL - Erection of 4 bungalows with new access and associated works - Land Off Elizabeth Lea Close & North Road, Bradworthy, Devon
Interests: Councillor Boughton declared a personal interest having called in the application, but attended with an open mind
Officer Recommendation: Grant subject to a S106 Agreement
The planning application had been called into Plans Committee for determination by Councillor Boughton for the following reason:
I would like to call this application in if the Officer is minded to Grant for the following reasons:
It is outside the Neighbourhood Plan and TDC Local Plan BRD01.
It is also piecemeal development to avoid contributions to affordable housing etc.
There is also concern over the suitability of the access off Elizabeth Lea Close”.
Prior to the presentation the following updates were reported to the Committee:
An email received from the Applicant responding to comments from the Parish Council in relation to the following matters:
· Lack of planning need for development;
· Option of business use on the site;
· Unsustainable nature of the development;
· Avoidance of planning contributions;
· Concerns about volume of traffic using Elizabeth Lea Close.
Condition 9 to be amended:
“The development hereby approved shall not be commenced until the road linking the application site to the existing highway at Elizabeth Lea Close is built out and at least 2 of the associated dwellings approved to the adjacent site to the west are completed (as approved under planning permission: 1/0771/2017/OUT & 1/0692/2019/REM).
Reason: To ensure that proper access is available for residents of these dwellings and the development does not result in an adverse impact on the surrounding landscape character.”
Amendments to be made in the report under “Planning Balance” –
· Should state “Full” and not Outline and “12” dwellings not 9
The Principal Planner presented the report and informed Members of the main planning considerations.
The primary concern expressed by Members was in relation to the increase in traffic using the access via Elizabeth Lea Close and the adverse impact on pedestrian safety. The Devon County Highways Officer addressed the concern, giving reasons as to why the proposed development provided safe and suitable access.
Further issues/concerns were raised and addressed. These included:
Service Strips – these are owned by the residents with Highways having a right of way over them.
This proposal being part of piecemeal development. Other approved sites within the applicant’s ownership – not yet been developed.
S106 Agreement –
· Recreational payments for Doctors Surgery – the Principal Planner advised that although requests had been received previously from the NHS on larger developments in Bradworthy - it does not reach the threshold in this instance.
