The Minutes of the meeting held on 16 January 2020 were agreed and signed as a correct record.

Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

Urgent Matters

Information to be brought forward with the permission of the Chair.

Minutes:

With the permission of the Chair, the Development Manager gave an update to Members in relation to a planning application for a wind turbine at Dolton which had been refused by the Plans Committee in 2019.  The Applicants subsequently submitted an Appeal to the Planning Inspectorate.

 

The Authority had received a letter from the Planning Inspectorate informing them that the Appeal had been “thrown out” as it was invalid, and therefore would no longer be considered.  The reason given was because the hub height of the turbine was above 15 metres – 50cm above. 

 

The Development Manager explained that, although there is no definition in legislation regarding the hub height, this would be defined by the Authority when validating such applications in the future.

 

The applicant has two options:

 

·         To resubmit amended plans, or

·         To carry out a full consultation exercise prior to submitting a new application

 

The Development Manager to forward a copy of the letter from the Planning Inspectorate to members of the Committee.

The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

Minutes:

Councillor Christie had received emails from residents expressing concerns in relation to applications 1/0981/2019/FUL and 1/0982/2019/LBC.  The LBC application had included “adopted parking”.   The Development Manager agreed to look into this oversight.
