Declaration of Interest

Members with interests to declare should refer to the Agenda item and describe the nature of their interest when the item is being considered.

 

Elected Members of Devon County Council and Town/Parish Councils who have considered a planning application by virtue of their membership of that Council hold a personal interest and are deemed to have considered the application separately and the expressed views of that Council do not bind the Members concerned who consider the application afresh.

Minutes:

The Chair reminded Members to declare their interests when the relevant item was up for discussion.  Declarations of interest were made as indicated below and in accordance with the previously agreed arrangements for “dual-hatted” Members.

95.

Urgent Matters

Information to be brought forward with the permission of the Chair.

Minutes:

With the permission of the Chair, Councillor Lock sought clarification from the Development Manager with regard to applications for the conversion/erection of annexes.  She referred to a particular application, for the conversion of a detached garage into a granny annex and where the advice given to the applicants had been positive.  This does not comply with the Joint Local Plan which states that an annex should be physically attached to the main building.

 

The Development Manager referred the Committee to Policy DM25 of the Local Plan which relates to extensions and annexes, and outlined the planning considerations of the Policy.

 

Councillor Christie raised the following:

 

1.    The Government had reinstated subsidies for wind turbines -  the installation/erection of wind turbines does not comply with Policies within the Joint Local Plan. 

 

2.    The expansion to Heathrow Airport had been ruled “unlawful” by the Court of Appeal on climate change grounds.  As a Planning Authority will climate change be considered more and more in the future?

 

The Development Manager addressed the above concerns:

 

1.    Wind Turbines – this is a matter for the Local Plan Working Group.  Officers from the Working Group will attend to give an update.

 

2.    Expansion to Heathrow Airport –  the weight given to climate change to be reviewed by Officers, as this will need to be taken into account.  

 

 

96.

Future Site Visits

The Chair to advise the Committee of any future site visits.

The Chair informed the Committee that there were currently no site visits planned.

Public Participation

The Chair to advise the Committee of any prior requests to speak made by members of the public and to advise of the details of the Council’s public participation scheme.

The planning application had been referred to Plans Committee because the land is in the ownership of Torridge District Council.

 

Prior to the presentation the Committee were informed of the following updates:

 

·         11 additional letters objecting to the application – a summary of the contents of the letters was given by the Principle Planner.

 

·         The Chair, Councillor Leather, read to the meeting an email he had received objecting to the application.

 

 

The Principle Planner presented the application and advised Members of the main planning considerations.

 

During the brief discussion that followed, Councillor Lock referred to the existing trees within the park that are to be retained, and proposed that an additional condition be imposed ensuring that the trees are protected.   It was agreed the wording of the Condition be delegated to the Development Manager in consultation with the Chair of Plans Committee.

 

It was proposed by Councillor Lock, seconded by Councillor Watson that the application be approved, and a recorded vote was taken.

·         Following receipt of the amended plans, a further consultation was undertaken – no further objections from neighbours was received.

 

·         Further comments received from Northam Town Council – approving the application.

 

The Planning Officer presented the report and advised Members of the main planning considerations.

 

The Development Manager referred to a comment made by the applicant when speaking on the application, that it would be a solid privacy screen.   The  condition in the report refers to obscure glazing.  It was suggested that Members agree to amend the condition to require further details of the screen for consideration.
